1. Sponsorship: Becoming an Approved Temporary Activities Sponsor

Before a 407 visa can be granted, the sponsoring organisation must be approved as a Temporary Activities Sponsor. To qualify, the organisation must be lawfully established and actively operating in Australia.

Eligible Sponsor Types

An approved sponsor must be one of the following:

  • An Australian organisation such as a company, body corporate, partnership, non‑profit organisation, or unincorporated body (excluding individuals, sole proprietors, or sole traders)
  • An Australian Commonwealth, state, or territory government agency
  • A foreign government agency operating in Australia (e.g., consulates, trade offices, media bureaus)
  • An international organisation recognised by Australia (e.g., the United Nations)
  • A superyacht operator, owner, or captain
  • A sporting organisation operating in Australia
  • A religious institution operating in Australia

Organisations operating under different ABNs must hold separate sponsorship approvals.

Special Rules for Trusts

A Trust cannot be a Temporary Activities Sponsor. Instead, the Trustee must apply for sponsorship. The Trustee must be an eligible Australian organisation such as:

  • a company
  • a body corporate
  • a partnership
  • a non‑profit organisation
  • an unincorporated body (excluding individuals or sole traders)

The application must be lodged under the Trustee’s legal name and ABN/ACN, and a copy of the trust deed must be provided. Religious institutions must ensure any charitable or tax‑exempt status applies to the Trustee, not the Trust.

Other Sponsorship Requirements

Sponsors must also:

  • Demonstrate the ability to meet sponsorship obligations
  • Have a strong business record with no adverse information
  • Comply with all Australian laws

2. Nomination: Approval of the Training Program

A nomination must be approved before the visa application can be lodged. The nomination outlines the training program and confirms itis a genuine, structured opportunity.

Types of Occupational Training

The 407 visa covers three categories of training:

1. Training Required for Registration

Workplace‑based training needed to obtain mandatory occupational registration, licensing, or membership in Australia or the applicant’s home country.

2. Training to Improve Skills in an Eligible Occupation

Structured workplace training that:

  • Is tailored to the applicant’s training needs
  • Relates to an occupation on the eligible skilled occupation list
  • Involves a trainee with at least 12 months of relevant full‑time experience or study completed within the last 24 months

3. Visa Application: Requirements for the Applicant

Once the nomination is approved, the applicant may lodge their Subclass 407 visa application. Applicants must meet several eligibility criteria.

Genuine Temporary Entrant

Applicants must genuinely intend to:

  • Stay temporarily in Australia
  • Comply with visa conditions

They must also have complied with conditions of previous visas.

Health Requirements

The applicant and any accompanying family members must meet Australia’s health requirements.

Character Requirements

Applicants aged 16 and over must meet character requirements. Additional family members may also be assessed.

Adequate Health Insurance

Applicants must maintain adequate health insurance for the entire stay. Insurance should cover medically necessary treatment and transport.

Some countries have reciprocal healthcare agreements with Australia, but private cover is still recommended.

English Language Requirement

Applicants must demonstrate functional English.

Visa Status Requirements (If Applying in Australia)

Applicants must hold a valid temporary substantive visa, excluding:

  • Subclass 403 (Domestic Worker - Diplomatic/Consular stream)
  • Subclass 771 (Transit)
  • Special Purpose visas

If the applicant does not currently hold a substantive visa, they may still apply if:

  • Their last substantive visa was not one of the excluded visas, and
  • The application is lodged within 28 days of the previous visa expiring or receiving an ART/Ministerial decision relating to visa cancellation
